Terms of service

1. The agreement

These Terms of Service (the “Terms”) govern your use of the medk.AI website and application (the “Service”), operated by medk.AI (“we”, “us”). By creating an account or using the Service you agree to these Terms and to the Privacy Policy, which together form the entire agreement between you and us concerning the Service. If you do not agree, do not use the Service.

2. What the Service is, and what it is not

The Service stores the documents you upload and presents their contents to you, organised, tracked over time, and explained in plain language, using automated artificial intelligence processing. The Service is an organisational and informational tool. It is not a medical device, it does not provide medical advice, diagnosis, or treatment, and its output must never be the basis for starting, stopping, or changing any treatment or for delaying contact with a qualified healthcare professional. Automated reading can contain errors; for this reason every extracted value links back to the page of the original document it came from, and you should verify any value on which you intend to rely. Always consult a qualified healthcare professional about your health.

3. Eligibility and your account

You must be at least eighteen years of age to hold an account. You sign in with a Google account or with a one-time link sent to your email address; keeping access to that account or inbox secure is your responsibility, and actions taken through your signed-in session are attributed to you. You agree to provide accurate information and to use the Service only for yourself and for people whose records you are lawfully entitled to hold and manage, as set out in section 4.

4. What you may upload

You may upload your own documents, and the documents of other people only where you genuinely hold the authority to possess and share them, such as records of family members you care for. For any person under eighteen years of age, you must hold parental responsibility for that person and you confirm this when adding them; persons under eighteen are never given their own access. You must not upload records you have no right to hold, any other person’s records without authority, or any unlawful content. We may suspend processing of content that reasonably appears to violate this section.

5. Subscriptions, billing, and taxes

Paid plans, their prices, and what they include are described on our pricing page. Payments are handled by Stripe under Stripe Managed Payments. Stripe, not medk.AI, is the seller on the receipt, and its name appears on your statement. Stripe handles sales tax and VAT, fraud screening, disputes, refunds, and transaction-level customer support. Sales are not available to buyers in Ascension Island, China, Cuba, Iran, Kosovo, North Korea, Russia, Syria, or Tristan da Cunha. Subscriptions renew automatically at the end of each billing period until cancelled. Where we have invited you to an early package, you get the free period if shown at checkout: your card is captured at checkout and the first charge is made when that free period ends. After a failed payment, your account keeps working for fourteen days while we retry, and access pauses after that if the payment still fails. Prices for new periods may change; we will give you notice of any price change before it applies to you, and where we have granted you a written price commitment, that commitment is honoured according to its stated conditions.

6. Family plans

A family plan lets one subscriber’s paid plan cover the accounts of other people. Only people aged 18 or over may be invited to or join a family plan. Each member holds their own account and signs in with their own credentials.

The plan owner may see only the list of members and a usage count per member, which exists for billing. The owner never sees a member’s results, readings or files, or the profile facts the member gives for the people they manage, unless the invite carried the owner’s per-member request to see them AND the member agreed to it in the app, and the member may stop that at any time. The owner never sees the profile facts a member gives about themselves. Member data belongs to the member, not to the plan owner: the owner holds no right to export, sell, or share it, and this section states the owner’s whole set of rights over member data.

The owner may remove a member at any time, and a member may leave the plan at any time. Either way, the owner’s access to the member’s data ends immediately, and the member’s data stays in the member’s own account, handled as the Privacy Policy describes. Members must not attempt to access any other account’s data, including the plan owner’s (see section 11).

7. Cancelling, and refunds

You may cancel at any time, from the Change card or cancel button in your settings. Cancelling stops the next renewal and nothing further is charged: your subscription and your full access continue to the last day of the period you have already paid for, and end there. Cancelling does not delete your data, and deleting your data does not by itself cancel a subscription; each is a separate, clearly labelled action in your settings: Change card or cancel for cancellation, and the delete controls for your data, so that neither ever happens by surprise.

You may withdraw from a new subscription within fourteen days of taking it out; because the Service begins immediately at your request, the refund of that first payment is reduced by an amount proportionate to what has already been supplied. Renewal payments are not refundable. Where the Service did not conform to what was described and was not brought into conformity within a reasonable time, the remedies the mandatory consumer law of your own country gives you apply. The Refund Policy sets all of this out in full and forms part of these Terms, and nothing in it reduces the rights the mandatory consumer law of your own country gives you.

8. Referral rewards

Every account can share its own invite link, shown in settings. When a person who creates an account through your link becomes a paying subscriber and stays one, we move your own renewal date forward: by one month once their monthly subscription has been paid six times, or by two months once their yearly subscription has run sixty days past purchase. The extension applies itself to your next renewal. There is nothing to claim, and no reward is ever paid out in cash or refunded from a payment already made.

One reward exists per person referred, ever, no matter how many links reach them: the first link used counts. A reward matures only while you hold an active paid subscription yourself. Rewards are capped at twelve months per account per calendar year, and accounts that do not pay for the Service cannot earn them. Where a link's trail points to your own account, to invented accounts, or to any other arrangement that is not a genuine introduction, we may withhold the reward.

We may change or end this program. A change never takes back time that has already been added to your renewal.

9. Fair use

Document processing carries real cost, and the Service applies published fair-use limits: sixty documents per person per calendar month, three hundred documents per person in the first thirty days of that person’s profile, and a per-file size limit stated at upload. Additional allowance follows a dashboard reset so that restoring a library is never impeded. When a limit is reached, the Service says so plainly and processing resumes in the next period. If you genuinely need more, write to support@medk.ai. We may adjust these limits to prevent abuse, and will publish any change.

10. Your content and our licence

Your documents and your results remain yours. You grant us the limited licence necessary to store, process, and display them to you, which is the sole purpose for which we use them, as described in the Privacy Policy. We claim no other rights in your content. You may export everything and delete everything at any time, and the licence ends when your content is deleted, except for the narrow legal retention described in the Privacy Policy. The Service’s own software, design, and text are our property or that of our licensors, and these Terms grant you a personal, non-transferable right to use the Service and no other rights in it.

11. Acceptable use

You agree not to: attempt to access data belonging to another account; probe, disable, or overload the Service or its infrastructure; use automated means to bulk-extract content from the Service other than your own export; resell or commercially redistribute the Service; or use the Service in violation of applicable law. We may suspend or terminate accounts that materially breach this section, with your right to export your data preserved wherever the law allows.

12. Availability and changes

We aim to keep the Service continuously available but do not promise uninterrupted operation. We may change, add, or remove features. If we discontinue the Service entirely, we will give you at least sixty days’ notice and preserve your ability to export your documents throughout that period.

13. Disclaimers and liability

The Service is provided as it stands. To the maximum extent the applicable law permits, we disclaim implied warranties, and our total aggregate liability to you for all claims arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from intent or gross negligence, nor does anything in these Terms reduce the protections that the mandatory consumer law of your country of residence grants you.

14. Changes to these Terms

We may amend these Terms. For material changes, we will notify you and, where the change affects how your documents are processed, ask for your renewed agreement before the Service continues processing. The version date at the top of this page identifies the text you agreed to. Continued use after notice of non-material changes constitutes acceptance.

15. General

If any provision of these Terms is held invalid, the remainder continues in effect, and the invalid provision is replaced by a valid one that most closely achieves its purpose. A failure to enforce a provision is not a waiver. You may not assign your account; we may assign this agreement as part of a transfer of the Service, with your rights preserved.
